Overview
These Terms of Service govern your access to and use of Flames, including our website, platform, APIs, and all related services (collectively, the "Service"). By creating an account or using Flames in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use Flames. By using the Service, you represent that you meet this requirement and that you have the legal authority to enter into these Terms on behalf of yourself or your organization.
If you are using Flames on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Your Account
Account Creation To access most features of Flames, you will need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account Security You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@flames.dev if you suspect unauthorized access to your account.
Account Termination You may close your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
3. Use of the Service
Permitted Use You may use Flames only for lawful purposes and in accordance with these Terms. You agree to use the Service to write, review, and ship code — and not to misuse, reverse engineer, or exploit the platform in any way not expressly permitted.
Prohibited Use You agree not to:
Use Flames to generate code intended to cause harm, enable unauthorized access, or facilitate illegal activity
Attempt to reverse engineer, decompile, or extract the underlying models or systems powering Flames
Use automated means to access the Service in a manner that exceeds reasonable usage or places undue burden on our infrastructure
Resell, sublicense, or commercially exploit the Service without explicit written permission from Flames
Upload or process any data that violates applicable laws or the rights of third parties
Impersonate any person or entity or misrepresent your affiliation with any person or entity
4. Your Code and Data
Ownership You retain full ownership of all code, content, and data you process through Flames. We make no claim of ownership over your repositories, files, or any output generated on your behalf.
Code Processing When you connect a codebase to Flames, we process your code solely to provide the Service. Your code is never stored beyond the active session and is never used to train any AI model. Enterprise customers may opt for fully self-hosted deployment where code never leaves their own infrastructure.
Accuracy Flames generates code based on AI models and your codebase context. All generated code should be reviewed before use in production. You are solely responsible for reviewing, testing, and deploying any code generated by Flames.
5. Intellectual Property
Flames IP All rights, title, and interest in and to the Flames platform — including its software, design, trademarks, and content — belong exclusively to Flames, Inc. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.
Feedback If you submit feedback, suggestions, or ideas about Flames, you grant us a perpetual, royalty-free license to use that feedback without restriction or compensation to you.
6. Subscription and Billing
Plans Flames offers a free Starter plan and paid Pro and Enterprise plans. Paid plans are billed on a monthly or annual basis as selected at checkout.
Payment By subscribing to a paid plan, you authorize Flames to charge your payment method on a recurring basis. All fees are non-refundable except where required by law or at our sole discretion.
Plan Changes You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. Downgrading may result in loss of access to certain features.
Free Trial If you use a free trial, your payment method will be charged at the end of the trial period unless you cancel before it ends.
7. Service Availability
We strive to maintain high availability of Flames but do not guarantee uninterrupted access. We may perform maintenance, deploy updates, or experience downtime from time to time. We will make reasonable efforts to notify users of planned maintenance in advance.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Flames disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, that defects will be corrected, or that any generated code will be accurate, complete, or suitable for any particular purpose.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Flames and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service — including but not limited to loss of data, loss of revenue, or costs of substitute services.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to Flames in the twelve months preceding the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Flames, Inc. and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses — including reasonable legal fees — arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Third-Party Services
Flames integrates with third-party services such as GitHub, GitLab, Slack, and others. Your use of those services is governed by their own terms and privacy policies. Flames is not responsible for the practices or content of any third-party service.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending a notice to your registered email address.
Your continued use of Flames after changes become effective constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flames regarding your use of the Service and supersede all prior agreements, understandings, or representations.
